Terms of Service

1. Agreement to Terms

By accessing or using Giftsie's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Service Description

Giftsie provides a concierge gifting service including gift curation, procurement, wrapping, and delivery coordination. The pilot program is a limited-capacity offering with special pricing and terms for early adopters.

3. User Responsibilities

You agree to provide accurate information during signup and intake, respond to our communications in a timely manner, set realistic budgets and timelines, and review and approve gift selections before finalization (unless you choose the surprise option).

4. Payment Terms

Service fees are charged upfront at signup (Valentine's: $30, 3-Event Bundle: $90, À la carte: $40 per event). Gift budgets (minimum $25 per event) are funded separately via our Venmo Business account after checkout. We'll provide Venmo details in your confirmation email.

5. Intellectual Property

All content, branding, and materials provided by Giftsie remain our intellectual property. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Limitation of Liability

Giftsie is not liable for delays caused by third-party vendors, shipping carriers, or circumstances beyond our control. We make every effort to curate thoughtful gifts, but satisfaction is subjective and we cannot guarantee recipient reactions.

7. Modifications to Service

We reserve the right to modify or discontinue services with reasonable notice. Pilot participants will be notified of any significant changes that affect their service.

8. Governing Law

These terms are governed by the laws of the State of Montana, United States. Any disputes will be resolved in the courts of Missoula County, Montana.

Privacy Policy

1. Information We Collect

We collect information you provide directly (name, email, address, preferences, occasion details) and automatically (device information, usage data, cookies). This information helps us provide personalized gifting services.

2. How We Use Your Information

We use your information to provide and improve our services, curate personalized gifts, coordinate delivery, communicate with you about your account and services, process payments, and send service-related updates. We may also use aggregated, anonymized data for analytics and service improvement.

4. Data Security

We implement industry-standard security measures to protect your information, including encryption, secure servers, and access controls. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

5. Your Rights

You have the right to access, update, or delete your personal information at any time. You can opt out of marketing communications while still receiving service-related messages. Contact us at [email protected] to exercise these rights.

6. Cookies and Tracking

We use cookies and similar technologies to enhance your experience, remember your preferences, and analyze site usage. You can control cookie settings through your browser, though some features may not function properly if cookies are disabled.

7. Children's Privacy

Our services are not directed to individuals under 18. We do not knowingly collect personal information from children. If we learn we have collected such information, we will delete it promptly.

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes via email or through our website. Continued use of our services after changes constitutes acceptance of the updated policy.

Refund Policy

1. Service Fee Refunds

Service fees are non-refundable once your intake consultation is complete and we've begun curating for your event. If you cancel before we start work, we'll issue a full refund minus a $25 processing fee. Refund requests must be submitted in writing to [email protected].

2. Gift Budget Refunds

Unused gift funds automatically roll forward to your next event. At the end of the pilot, any remaining gift budget balance can be refunded upon request. Once we've procured items based on your approval, those specific funds are non-refundable, as we've already invested in items for your recipient.

3. Cancellation Timeline

You may cancel or reschedule individual occasions up to 2 weeks before the scheduled delivery date. Cancellations within 2 weeks may incur fees if gifts have already been purchased or wrapping has begun.

4. Dissatisfaction with Gifts

We work closely with you to ensure satisfaction before gifts are finalized. If you're not happy with our selections during the review phase, we'll revise at no additional cost (up to 5 revisions for pilot package, one revision for à la carte). If you choose the surprise option and skip the review phase, we cannot offer refunds based on personal preference. Once you approve and gifts are delivered, we cannot offer refunds based on recipient reactions or changed preferences.

5. Damaged or Lost Items

If gifts arrive damaged or are lost in transit, please notify us within 48 hours of expected delivery. We'll work with carriers to file claims and will replace items or issue refunds as appropriate. We are not responsible for delays or issues caused by incorrect addresses provided by you.

6. Refund Processing

Approved refunds will be processed within 7-10 business days to the original payment method. You'll receive an email confirmation once the refund has been initiated.

Delivery & Shipping Policy

1. Delivery Options

We offer local delivery in Missoula, Montana and surrounding areas only. The pilot program is limited to local residents. Delivery typically occurs within 1-2 business days of the scheduled date.

2. Delivery Windows

During your intake, we'll establish delivery windows for each occasion. We coordinate closely with you to ensure gifts arrive at the right time. For time-sensitive occasions (birthdays, anniversaries), we build in buffer time to account for any unforeseen delays.

3. Address Accuracy

You are responsible for providing accurate delivery addresses. We cannot be held liable for delays or failed deliveries due to incorrect addresses. If a package is returned due to an address error, you may be charged for re-shipping.

4. Signature Requirements

For high-value gifts (over $200), we may require signature confirmation upon delivery. We'll notify you in advance if this applies to your order. If no one is available to sign, the carrier will leave a notice for pickup or rescheduled delivery.

5. Tracking Information

For shipped orders, you'll receive tracking information via email once your gift is dispatched. You can monitor the delivery status through the carrier's website. For local deliveries, we'll provide estimated delivery windows and confirmation upon completion.

6. Delivery Issues

If you experience any delivery issues (delays, damage, missing items), please contact us immediately at [email protected]. We'll work with carriers to resolve the issue and ensure your gift reaches its destination in perfect condition.

7. International Shipping

International shipping is not currently available during the pilot phase. We plan to expand internationally based on pilot feedback and demand.
